Division of Property after Dissolution of the Marriage
The present practice memo describes the legal and practical considerations with regards to the division of divorcees’ assets after the marriage dissolution. It explains, inter alia, in which cases a spouse can claim a a right over marital property; when a spouse is deemed to have contributed to the increase of marital property and what powers does the competent Family Court has in such cases. Moreover, other issues that are examined in the present practice memo are penal offences and sanctions for non-conformity, disclosure of assets and Court examination, loss of right to raise a claim and diminution of award value, filings, indicative fees and all the other relevant matters. It goes further to include an indicative step plan of the above-mentioned processes along with a description of the requisite documents.
