Standard Tenancy Agreement (STA)
This document is a standardized tenancy agreement ("STA") under Cyprus law.
It is meticulously designed for ease of use, in a manner where participants (or their advisers) only fill in the commercial terms, such as the parties, the property and the agreed rent, and all legal terms and conditions are standard.
The said legal terms are meant to thoroughly include all relevant tenancy terms in a fair and balanced manner, not inclined in favour of the landlord or the tenant, thus no further negotiation is needed. To achieve this, the author and his team conducted thorough and rigorous research on hundreds of variations of tenancy agreements and have considered case law, dedicated experience of over 10 years and the feedback of peers (both property and litigation specialists), real estate agents, property managers and other real estate industry practitioners.
Ideally tenancy agreements are prepared and reviewed by legal advisors, and all terms are independently negotiated against specific facts and circumstances. In practice however, in the majority of cases, the issues which arise are common and could be reflected in somewhat balanced standardized terms thus avoiding the cost, time and other unnecessary friction of independent negotiations.
The idea of standardized agreements has worked successfully for decades for the construction industry and is in fact a step towards the digital-only era we are entering, and prevailing best practices around the world.
You can fill the STA electronically or you can print it and fill it in by hand. To avoid claims of invalidity, at present, it is advisable that it is signed physically, in the presence of witnesses. It can be used with ease by landlords, tenants, their lawyers, real estate advisors and other industry practitioners who only need to discuss, negotiate and agree commercial terms.
You can download the Standard Tenancy Agreement for free but you need to purchase a licence each time you use it, namely for each individual property, each time you use it. Use without purchasing a licence is prohibited and constitutes a copyright infringement which is actionable as a civil and criminal offence. Instances of unauthorized use will be persecuted to the full extent of the law against all parties involved.
